"PORTLAND UNDERGROUND TOURS"
PARTICIPANT AGREEMENT & LIABILITY WAIVER
In consideration for being allowed to participate in the Cascade Geographic Society's "Portland Underground Tours", I, the undersigned, agree as follows:
1. That I will fully cooperate with the tour leader & any building or business owner, employee, etc., whose establishment I visit;
2. That I am fully aware that business is being conducted in all or in the majority of the establishments I will visit & that I will not block or disrupt any of the services being delivered;
3. That the tour could involve sites both below & above ground & I will not block sidewalks or impede the flow of pedestrian traffic;
4. That I will not return to those sites included in the "Portland Underground Tours" except with the tour guide, Michael P. Jones of the Cascade Geographic Society, or except to utilize any business(es) as a customer;
5. That I do not have any physical, mental, or emotional disability or illness that would cause me any difficulties or harm as a participant in Cascade Geographic Society's "Portland Underground Tours";
6. That I will not use the information I obtain as a result of participating in the Cascade Geographic Society's "Portland Underground Tours" to assist any other business or entity which engages, or may in the future engage, in tours or activities which may compete with Cascade Geographic Society.
7. That I will not use the information I obtain as a result of participating in the Cascade Geographic Society's "Portland Underground Tours" to write any books, magazine or newspaper articles, plays, video or film scripts, CD ROMs, games, audio tapes, etc., including assisting any other entity in these activities, without prior written permission from Michael P. Jones.
8. I UNDERSTAND THERE ARE KNOWN & UNKNOWN DANGERS WHICH WILL BE ENCOUNTERED ON THIS TOUR, & I HEREBY WAIVE ANY CLAIMS FOR LIABILITY THAT I HAVE, OR MAY IN THE FUTURE HAVE, AGAINST "PORTLAND UNDERGROUND TOURS" AND/OR THE CASCADE GEOGRAPHIC SOCIETY, INC., AND/OR MICHAEL P. JONES, AND/OR NAITO PROPERTIES, AND/OR HOBO'S RESTAURANT, AND/OR THE BOILER ROOM NIGHTCLUB, ANY STAFF OR VOLUNTEERS, OR ANY BUSINESSES, THEIR OWNER(S) & EMPLOYEES, & HEREBY RELEASE THOSE PARTIES FROM ANY CLAIMS WHICH I HAVE OR MAY IN THE FUTURE HAVE AS A RESULT OF THIS TOUR FOR ANY HARM OR INJURIES THAT I MAY SUSTAIN, SPECIFICALLY INCLUDING ANY HARM OR INJURIES THAT I MAY SUSTAIN AS A RESULT OF THE NEGLIGENCE OF ANY OF THE ABOVE PARTIES.I also understand that the Cascade Geographic Society can not make refunds for spaces reserved and not used or for persons needing to leave tours.
